Acceptable Use Policy
Conduct that is prohibited on the Hardline platform. This Policy supplements and is incorporated into the Terms of Service.

1.Scope and Incorporation
This Acceptable Use Policy (this “AUP”) governs your use of the Hardline Service and is incorporated into, and is part of, the Terms of Service. Capitalized terms used and not defined in this AUP have the meanings given in the Terms of Service. Violation of this AUP is a material breach of the Terms of Service and may result in suspension or termination under Section 17 of the Terms of Service and indemnification under Section 14 of the Terms of Service.
2.Lending-Marketplace-Specific Prohibitions
You will not, and you will not permit any third party to, do any of the following in connection with your use of the Service:
You will not use the Service to make, broker, request, solicit, originate, or fund any loan that is, or may be characterized as: (i) a consumer-purpose loan within the meaning of 12 C.F.R. § 1026.3(a)(1); (ii) a loan secured by an owner-occupied dwelling, second home, or vacation home of the borrower or any guarantor or any immediate family member of either; (iii) a loan subject to the Truth in Lending Act (15 U.S.C. § 1601 et seq.), the Real Estate Settlement Procedures Act (12 U.S.C. § 2601 et seq.), the Home Ownership and Equity Protection Act, the Dodd-Frank Ability-to-Repay rule (12 C.F.R. § 1026.43), or the S.A.F.E. Act, unless you have independently confirmed and represented in writing to your counterparty that you hold all applicable licenses and have made all required disclosures; or (iv) a high-cost mortgage under any federal or state law.
You will not misrepresent any deal, property, loan term, financial information, identity, authority, intent, or fact material to a transaction. You will not engage in straw-borrower arrangements, undisclosed flips, undisclosed kickbacks, sham transactions, transactions designed to disguise the source or use of funds, or any other arrangement designed to evade applicable law.
You will not use the Service to conduct any activity for which you are required to be (but are not) licensed, registered, or exempt under federal or state law, including the mortgage broker, mortgage lender, mortgage loan originator, finance lender, finance broker, real-estate broker, money transmitter, money services business, securities broker-dealer, investment adviser, and commodity-pool operator licensing and registration regimes.
You will not extend credit to, accept credit from, transact with, or otherwise facilitate any transaction involving any person, entity, or jurisdiction that is the subject of comprehensive U.S. economic sanctions, that appears on the OFAC Specially Designated Nationals and Blocked Persons List or other consolidated sanctions list, or that is owned 50% or more in the aggregate by sanctioned persons. You will not use the Service to facilitate money laundering, terrorist financing, sanctions evasion, tax evasion, or any other illegal activity, and you will promptly notify Hardline if you have reason to believe another User has done so.
You will comply with the Equal Credit Opportunity Act (15 U.S.C. § 1691 et seq.), Regulation B (12 C.F.R. Part 1002), the Fair Housing Act (42 U.S.C. § 3601 et seq.), the Servicemembers Civil Relief Act (50 U.S.C. § 3901 et seq.), and all applicable state fair-lending and fair-housing laws. You will not discriminate against any applicant, borrower, or counterparty on the basis of race, color, religion, national origin, sex (including gender identity and sexual orientation), marital status, age (provided capacity to contract), familial status, disability, source of income, military status, or the good-faith exercise of any right under the Consumer Credit Protection Act.
You will not rely on wire instructions exchanged through the Service without first independently verifying the instructions verbally with a known person at the counterparty using contact information obtained outside the Service. You will not transmit wire instructions through the Service knowing or having reason to know that the instructions are false, fraudulent, or compromised. See Disclosures § 4.
You will not use the Service to offer, sell, or solicit interest in any security, fractional loan participation, note, syndicated participation, fund interest, or any instrument that may constitute a “security” under the Securities Act of 1933, the Securities Exchange Act of 1934, the Investment Company Act of 1940, the Investment Advisers Act of 1940, or any state Blue Sky law, without first independently confirming compliance with applicable registration or exemption requirements.
3.Platform-Integrity Prohibitions
You will not (i) gain or attempt to gain unauthorized access to the Service, to other Users’ accounts, or to any data not intended for you; (ii) circumvent or attempt to circumvent any rate limit, access control, captcha, security measure, or technical restriction; (iii) reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying ideas or algorithms of the Service, except to the limited extent permitted by mandatory applicable law that cannot be lawfully waived; (iv) probe, scan, or test the vulnerability of the Service, except as permitted by the Coordinated Vulnerability Disclosure provisions in Section 22 of the Terms of Service; or (v) interfere with or disrupt the Service or its underlying servers, networks, or infrastructure.
You will not upload, transmit, or introduce any virus, worm, trojan horse, ransomware, time bomb, logic bomb, keystroke logger, spyware, or other malicious code into the Service or to other Users.
You will not scrape, crawl, spider, harvest, or otherwise extract data from the Service by automated means, by manual means at scale, by use of a third-party service, or by use of any browser extension or script designed for that purpose, except (i) standard search-engine crawlers obeying the Service’s `robots.txt`, or (ii) as expressly authorized by Hardline in writing. This Section operates as an express withdrawal of authorization for purposes of the federal Computer Fraud and Abuse Act, 18 U.S.C. § 1030.
You will not use the Service to send unsolicited commercial messages, chain communications, phishing or pretexting messages, or social-engineering attacks against other Users, Hardline personnel, or any third party. You will not impersonate any person or entity or misrepresent your affiliation with any person or entity.
You will not resell, rent, lease, sublicense, transfer, assign, or otherwise commercialize access to the Service without Hardline’s prior written consent. The Service is licensed to you for your own use as a Borrower or Lender.
4.Content Restrictions
You will not submit, post, upload, or transmit through the Service any content that:
- infringes, misappropriates, or violates a third party’s intellectual-property rights, privacy rights, publicity rights, contractual rights, or other legal rights;
- contains personal information about any third party that you are not authorized to share;
- is unlawful, defamatory, libelous, threatening, harassing, abusive, fraudulent, obscene, pornographic, or otherwise objectionable;
- contains material non-public information about a publicly traded company;
- discloses confidential information of a third party without authorization;
- contains the personal information of a minor;
- misuses Hardline’s name, marks, or branding without authorization.
5.Anti-Bribery and Anti-Corruption
You will comply with all applicable anti-bribery and anti-corruption laws, including the U.S. Foreign Corrupt Practices Act (15 U.S.C. §§ 78dd-1 et seq.), the U.K. Bribery Act 2010, and analogous state commercial-bribery statutes. You will not, directly or indirectly, offer, give, or authorize the giving of anything of value to any person to obtain or retain business through the Service.
6.Enforcement; Reservation of Rights
Hardline may, in its sole discretion: (i) investigate suspected violations of this AUP; (ii) request information from a User believed to have violated this AUP; (iii) remove, restrict access to, or modify content believed to violate this AUP; (iv) suspend or terminate accounts under Section 17 of the Terms of Service; (v) report violations to law enforcement, regulators, or affected third parties; and (vi) cooperate with lawful investigations. Hardline’s exercise or non-exercise of any of these rights in any instance creates no duty to act in any other instance.
Nothing in this AUP limits any other right or remedy of Hardline under the Terms of Service, at law, or in equity. The rights of Hardline under this AUP are cumulative.
7.Reporting Violations
To report a suspected violation of this AUP, email security@hardlinelending.com (for security incidents) or legal@hardlinelending.com (for legal or compliance issues). Include sufficient detail to enable investigation. Hardline will acknowledge reports under the response timelines in Legal Contact.
8.Modifications
Hardline may modify this AUP from time to time. Material modifications will be made under the procedures in Section 18 of the Terms of Service. Each version of this AUP is archived at /legal/archive.
